Bullion Breaks Consignment Terms & Conditions
Effective Date: October 8, 2026
These Consignment Terms & Conditions (“Consignment Terms”) govern items submitted to Bullion Breaks (“Bullion Breaks,” “we,” “us,” or “our”) for consignment sale.
Bullion Breaks is located in Evansville, Indiana.
The purpose of the Consignment Program is to provide owners with an opportunity to have eligible items marketed and sold through Bullion Breaks and its approved sales channels while the consignor retains ownership until the item is sold and the applicable transaction is completed.
By submitting an item for consignment, entering into a Consignment Agreement, or allowing an item to be listed under the program, you acknowledge and agree to these Consignment Terms and any applicable individual Consignment Agreement.
1. How the Consignment Program Works
The general process is:
Submit → Review → Terms → Consignment Agreement → Inventory → Listing → Sale → Buyer Transaction Completed → Payout
Submission does not guarantee acceptance into the Consignment Program.
Bullion Breaks may accept or decline any item or submission.
2. Consignment Application
A prospective consignor may be asked to provide:
-
Name and contact information
-
Item description
-
Quantity
-
Photographs
-
Condition
-
Desired or target price
-
Minimum acceptable price
-
Preferred selling strategy
-
Authentication or grading information
-
Purchase or ownership information when relevant
-
Other information reasonably needed to evaluate the item
Providing this information does not guarantee that Bullion Breaks will accept the item.
3. Ownership of Consigned Items
Unless otherwise stated in a separate written agreement, the consignor retains ownership of the item during the consignment period until:
-
The item is sold;
-
The buyer's transaction is completed;
-
Applicable return or dispute periods have been satisfied; and
-
Ownership is transferred or otherwise resolved according to the applicable transaction and agreement.
Bullion Breaks does not purchase the item merely because it has been accepted for consignment.
4. Authority to Consign
The consignor represents that they are the lawful owner of the item or have legal authority to consign it.
The consignor may not submit property that:
-
They do not own or have authority to consign;
-
Is stolen or unlawfully obtained;
-
Is subject to another person's ownership claim;
-
Is subject to a lien or restriction that prevents the consignment; or
-
They otherwise lack authority to place into the Consignment Program.
Bullion Breaks may request documentation establishing ownership or authority.
5. Consignment Agreement
An item will not be listed for sale until the applicable Consignment Agreement has been accepted.
The Consignment Agreement may establish specific terms including:
-
Commission
-
Fees
-
Listing price
-
Minimum acceptable price
-
Price-adjustment authority
-
Listing period
-
Marketing strategy
-
Withdrawal terms
-
Shipping responsibilities
-
Payment terms
-
Return or dispute procedures
-
Other transaction-specific conditions
The specific Consignment Agreement controls where it conflicts with these general Consignment Terms.
6. Initial Listing Period
The standard initial consignment listing period is 90 days unless a different period is agreed to in writing.
The 90-day period is intended to provide a reasonable opportunity to market and sell the item.
The listing period does not guarantee a sale.
Bullion Breaks may agree to extend a listing period when appropriate.
7. No Guarantee of Sale
Bullion Breaks does not guarantee that a consigned item will sell.
The timing and price of a sale may depend on:
-
Market conditions
-
Buyer demand
-
Product desirability
-
Price
-
Condition
-
Rarity
-
Competition
-
Advertising exposure
-
Inventory levels
-
Marketplace conditions
-
Precious-metal market fluctuations
-
Other factors outside Bullion Breaks' control
8. Pricing
The consignor may provide:
-
A target price;
-
A minimum acceptable price; and
-
A preferred selling strategy.
A target price is not necessarily the final selling price.
Bullion Breaks will follow the pricing authority established in the applicable Consignment Agreement.
Bullion Breaks will not knowingly sell below an agreed minimum price unless the consignor has authorized such a change.
9. Price Adjustments
Price adjustments may be made only according to the authority provided in the applicable Consignment Agreement.
If the agreement requires consignor approval before a price change, Bullion Breaks will seek that approval before making the applicable adjustment.
Market-sensitive items may require special pricing provisions.
10. Commission and Fees
Bullion Breaks' commission and any applicable fees will be disclosed in the Consignment Agreement before the item is listed.
The consignor will be responsible for the agreed commission and fees associated with the sale.
The commission is generally calculated from the applicable sale proceeds according to the terms of the Consignment Agreement.
No commission or fee structure should be assumed to apply unless it is included in the applicable agreement.
11. Marketing and Listing
Bullion Breaks may market accepted consignment items through approved sales channels.
Marketing may include:
-
BullionBreaks.com
-
Online marketplaces
-
Social media
-
Promotional materials
-

-
Other approved sales channels
Bullion Breaks may determine the appropriate presentation, photography, description, category, and marketing strategy, subject to the applicable Consignment Agreement.
12. Product Descriptions and Photographs
Bullion Breaks may photograph, describe, categorize, and market consigned items.
The consignor agrees to provide accurate information about the item.
Bullion Breaks may request additional photographs or documentation before listing.
Photographs may be edited for presentation purposes but will not intentionally misrepresent the item's material characteristics.
13. Consignment Inventory
Bullion Breaks may maintain records of consigned inventory, including:
-
Consignment ID
-
Item description
-
Photographs
-
Condition
-
Listing information
-
Pricing
-
Sale information
-
Payout information
The consignor should retain their own records of submitted items.
14. Withdrawal Before Sale
A consignor may request removal of an item before sale, subject to the applicable Consignment Agreement.
Withdrawal may be subject to:
-
Notice requirements;
-
Applicable fees;
-
Shipping or handling costs;
-
Listing or marketing expenses;
-
Existing buyer activity;
-
Other agreed terms.
A withdrawal request does not automatically require immediate removal if the item is subject to a transaction already in progress or other contractual obligations.
15. Withdrawal After a Buyer Transaction
Once a qualifying buyer transaction has been completed, or is otherwise in progress or legally or contractually committed, the consignor may not withdraw the item simply because they have changed their mind, except as permitted by the applicable Consignment Agreement or required by law.
This provision is intended to protect both Bullion Breaks and the buyer from a consignor withdrawing an item after Bullion Breaks has committed to completing a transaction.
16. Buyer Transactions
A consignment sale is not considered complete merely because a buyer places an order.
Bullion Breaks may need to receive and clear the buyer's payment and satisfy applicable return, dispute, cancellation, fraud-prevention, or other transaction requirements before the sale is considered final for payout purposes.
17. Payout to Consignor
Consignor payment will generally occur after:
-
The buyer has paid;
-
Payment has cleared;
-
The applicable buyer return period or transaction-finalization period has expired;
-
The transaction is not subject to an unresolved dispute or chargeback; and
-
All applicable Consignment Agreement conditions have been satisfied.
The payout amount will be calculated according to the applicable sale price, commission, fees, adjustments, and other agreed terms.
18. Chargebacks, Returns, and Buyer Disputes
If a buyer transaction is subject to a return, chargeback, fraud investigation, dispute, cancellation, or other unresolved issue, Bullion Breaks may delay the consignor's payout until the matter is resolved.
If a transaction is reversed after a consignor has been paid, the consignor may be responsible for amounts owed under the applicable Consignment Agreement.
Specific procedures may be established in the Consignment Agreement.
19. Item Condition and Disclosure
The consignor must disclose known material issues involving the item.
This may include:
-
Damage
-
Repairs
-
Alterations
-
Cleaning
-
Counterfeiting concerns
-
Restoration
-
Missing components
-
Reproduction status
-
Authentication concerns
-
Other material defects
Failure to disclose material information may result in rejection of the item, removal from sale, adjustment of terms, or other action permitted by the agreement and applicable law.
20. Authentication and Verification
Bullion Breaks may inspect or authenticate items when appropriate.
Bullion Breaks may use internal review or third-party authentication, grading, or verification services when appropriate.
Any associated cost or responsibility will be addressed in the applicable Consignment Agreement.
21. Counterfeit or Misrepresented Items
Bullion Breaks will not knowingly list counterfeit, stolen, fraudulent, or materially misrepresented items.
If a concern arises, Bullion Breaks may suspend the listing, retain the item temporarily for investigation where legally permitted, request documentation, or terminate the consignment relationship as appropriate.
22. Shipping and Delivery
Shipping arrangements for consigned items will be established before or during acceptance.
The consignor may be responsible for shipping the item to Bullion Breaks.
Bullion Breaks may establish packaging, insurance, tracking, and shipping requirements based on the item's value and type.
Do not ship an item until Bullion Breaks provides appropriate instructions.
23. Risk, Custody, and Protection
Once Bullion Breaks receives a consigned item, Bullion Breaks will use reasonable care in handling and storing the item.
Specific responsibility for loss, damage, shipping, insurance, or carrier claims will be governed by the applicable Consignment Agreement and circumstances of the loss.
Bullion Breaks may use insurance or carrier protection when available and appropriate.
24. Unsold Items
If an item does not sell during the initial 90-day listing period, Bullion Breaks may:
-
Offer an extension;
-
Discuss a revised price;
-
Return the item;
-
Continue listing under revised terms; or
-
Take another action agreed upon with the consignor.
The applicable Consignment Agreement will determine what happens at the end of the listing period.
25. Return of Unsold Items
When an item is returned to the consignor, Bullion Breaks may require the consignor to provide or confirm an accurate shipping address.
Applicable return shipping, handling, insurance, or other charges will be governed by the Consignment Agreement.
The consignor should inspect the returned item promptly and notify Bullion Breaks of any apparent issue.
26. Consignor Responsibilities
The consignor is responsible for:
-
Providing accurate information;
-
Establishing ownership or authority;
-
Disclosing known defects;
-
Providing requested documentation;
-
Reviewing and accepting the Consignment Agreement;
-
Maintaining accurate contact information;
-
Communicating promptly when approval is required;
-
Following shipping instructions;
-
Paying agreed fees;
-
Complying with applicable laws.
27. Changes to Consignment Terms
Bullion Breaks may update these general Consignment Terms from time to time.
The terms applicable to an existing consignment will generally be determined by the Consignment Agreement accepted for that item.
A later change to these general terms will not automatically modify an existing Consignment Agreement unless permitted by that agreement or otherwise agreed by the parties.
28. Termination of Consignment Relationship
Bullion Breaks may terminate a consignment relationship when permitted by the applicable agreement or law.
Reasons may include:
-
Violation of the agreement;
-
False or misleading information;
-
Ownership concerns;
-
Counterfeit concerns;
-
Failure to provide required information;
-
Failure to pay agreed fees;
-
Abusive or fraudulent conduct;
-
Repeated disputes;
-
Other legitimate business or legal reasons.
The disposition of the consigned item following termination will be handled according to the applicable Consignment Agreement.
29. Taxes and Reporting
Consignors are responsible for determining and satisfying their own tax and reporting obligations associated with consignment sales.
Bullion Breaks may collect or report information when required by law.
Bullion Breaks does not provide individual tax advice.
30. Governing Law
These Consignment Terms are governed by the laws of the State of Indiana, except where applicable law requires otherwise.
31. Severability
If any provision is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
